Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Settlewell platform, operated by Official Canada Immigration Services Inc. ("we," "us," or "our"). By creating an account or using settlewell.ca, you agree to be bound by these Terms. If you do not agree, do not use the service.
1. Acceptance of Terms
By accessing or using Settlewell, you confirm that you are at least 16 years of age and that you have the legal capacity to enter into these Terms. If you are using the service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice on the platform. Your continued use of Settlewell after such changes constitutes your acceptance of the revised Terms.
2. Description of Service
Settlewell is an AI-powered immigration guidance platform that helps users understand Canadian immigration pathways, estimate CRS scores, track documents, and plan their immigration journey.
Settlewell is an informational tool. It provides general guidance based on publicly available immigration information. It does not provide legal, immigration, or professional advice. The platform is not a substitute for a licensed immigration consultant (RCIC) or lawyer. We do not submit applications on your behalf, and we are not responsible for the outcome of any immigration application.
3. Account Registration
To access certain features, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Keep your account credentials secure and confidential
- Maintain only one account per person
- Notify us promptly if you suspect unauthorized access to your account
You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription and Billing
Settlewell offers a free tier with limited features and paid subscription plans with additional capabilities. By subscribing to a paid plan, you agree to the following:
- Pricing — Current plan pricing is displayed on our Pricing page. All prices are in Canadian dollars unless otherwise stated.
- Auto-renewal — Paid subscriptions renew automatically at the end of each billing cycle (monthly or annual) unless you cancel before the renewal date.
- Cancellation — You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.
- Refunds — We offer a 30-day money-back guarantee on your first subscription payment. After 30 days, payments are non-refundable. If you cancel mid-cycle, you will not receive a prorated refund.
- Price changes — We may adjust pricing with at least 30 days' notice. Price changes apply at the start of your next billing cycle.
5. Acceptable Use
You agree to use Settlewell only for its intended purpose — personal immigration guidance and planning. You may not:
- Share your account credentials with others or allow multiple people to use a single account
- Use automated tools, bots, or scripts to scrape, extract, or collect data from the platform
- Reverse-engineer, decompile, or attempt to extract the source code of the platform
- Use the service to provide immigration consulting services to third parties without our written consent
- Upload malicious content, attempt to gain unauthorized access, or interfere with the platform's operation
- Misrepresent your identity or provide false information in your immigration profile
- Reproduce, distribute, or publicly display any content from the platform without our permission
We reserve the right to suspend or terminate your account if you violate any of these restrictions.
6. User-Generated Content and AI Interactions
You are solely responsible for the accuracy and completeness of any information you provide through your immigration profile, AI chat interactions, and any other inputs to the platform.
- We may review content and interactions for quality assurance, security, and service improvement purposes
- We reserve the right to remove or restrict access to content that violates these Terms or applicable law
- AI chat responses are generated based on the information you provide and publicly available immigration data — the quality and relevance of the output depends on the accuracy of your input
- We do not guarantee that AI-generated responses are error-free, and you should independently verify any information before acting on it
7. Intellectual Property
Our property — The Settlewell platform, including its design, code, features, content, branding, and AI models, is owned by Official Canada Immigration Services Inc. and is protected by Canadian and international intellectual property laws. These Terms do not grant you any ownership rights in the platform.
Your data — You retain ownership of the personal information and immigration profile data you provide to Settlewell. By using the service, you grant us a limited license to use your data solely to operate and improve the platform, as described in our Privacy Policy.
8. Service Availability
We aim to provide reliable, continuous access to Settlewell, but we do not guarantee 100% uptime. The service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice where possible)
- Unplanned outages caused by technical issues, infrastructure failures, or circumstances beyond our control
- Updates, upgrades, or changes to the platform
We reserve the right to modify, suspend, or discontinue any feature of the service with reasonable notice. We will not be liable for any loss or inconvenience caused by service interruptions.
9. Disclaimer
Settlewell provides general guidance and information only. It does NOT provide legal, immigration, or professional advice. You must not rely on the platform as a substitute for professional consultation. For legal matters, always consult a licensed Regulated Canadian Immigration Consultant (RCIC) or immigration lawyer. We are not responsible for immigration application outcomes.
You acknowledge that immigration laws and policies are complex, change frequently, and vary by individual circumstance. Any scores, assessments, or recommendations provided by Settlewell are estimates only and should not be the sole basis for immigration decisions.
Settlewell does not guarantee the accuracy, completeness, or timeliness of any information on the platform. While we make reasonable efforts to keep our content current, immigration rules may have changed since the information was last updated.
The platform is provided "as is" and "as available." We make no warranties, express or implied, regarding the suitability of the information provided. Specifically, we disclaim all warranties of:
- Merchantability and fitness for a particular purpose
- Accuracy of CRS score estimates, pathway recommendations, or eligibility assessments
- Uninterrupted, error-free, or secure access to the platform
- Results or outcomes from any immigration application
- Completeness or currency of any immigration-related information
10. Limitation of Liability
To the maximum extent permitted by applicable law, Official Canada Immigration Services Inc. and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Settlewell, including but not limited to:
- Loss of data, revenue, or profits
- Delays or rejections in immigration applications
- Errors or omissions in the platform's content or recommendations
- Unauthorized access to your account or data
- Decisions made based on information provided by the platform
- Any third-party actions or services
Our total cumulative liability to you for all claims arising from or related to these Terms or your use of the service shall not exceed the total amount you have paid to us in the 12 months preceding the claim. If you are using the free tier, our total liability shall not exceed $50 CAD.
11. Indemnification
You agree to indemnify, defend, and hold harmless Official Canada Immigration Services Inc., its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through the service
- Any immigration decisions or actions you take based on information from the platform
12. Termination
You may close your account at any time by contacting us at hello@settlewell.ca or through your account settings.
We may suspend or terminate your access to Settlewell at any time, with or without notice, if we reasonably believe that you have violated these Terms or if continued access poses a risk to the platform or other users. Upon termination:
- Your right to use the service ends immediately
- We will handle your personal data in accordance with our Privacy Policy
- Sections of these Terms that by their nature should survive termination (including Disclaimer, Limitation of Liability, Indemnification, and Governing Law) will remain in effect
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Dispute resolution process: Before initiating any legal proceeding, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of 30 days from the date one party notifies the other in writing. If negotiation fails, the parties agree to attempt mediation administered by a mutually agreed-upon mediator before resorting to litigation.
If mediation is unsuccessful or if a party fails to participate in good faith, either party may pursue legal action. Any dispute shall be resolved exclusively in the courts of the Province of Quebec, sitting in the city of Montreal.
Nothing in this section prevents either party from seeking injunctive or equitable relief in cases of urgent necessity, including but not limited to the protection of intellectual property rights or confidential information.
14. Force Majeure
Neither party shall be liable for any failure or delay in performing their obligations under these Terms due to causes beyond their reasonable control, including but not limited to: natural disasters, acts of government or regulatory authorities, pandemic or epidemic, internet service disruptions, power outages, failure of third-party service providers, cyberattacks, or labour disputes. The affected party will make reasonable efforts to resume performance as soon as practicable.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice through the platform or by email at least 30 days before the changes take effect.
If you disagree with the updated Terms, you may close your account before the changes take effect. Your continued use of Settlewell after the effective date constitutes your acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
17. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Official Canada Immigration Services Inc. regarding your use of Settlewell. They supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter of these Terms.
